Motorcycle Traffic Laws in New York State: An Overview

Understanding and adhering to these laws is essential for legal compliance and road safety. As the roads clear of snow and ice, we thought it would be a good time to review some of the legal requirements of motorcycle owners and riders here in New York State.

Licensing and Registration Requirements

Before operating a motorcycle in NYS, riders must obtain a Class M or MJ (Junior) license To do so, individuals must:

  • Be at least 16 years old
  • Pass a written test to obtain a motorcycle learner’s permit.
  • Complete a road test or successfully finish the NYS Motorcycle Safety Program (MSF course), which can waive the road test requirement.

Additionally, motorcycles must be registered with the New York Department of Motor Vehicles and display a valid inspection sticker.

Helmet and Eye Protection Laws

New York has a universal helmet law, meaning all motorcycle riders and passengers must wear a U.S. Department of Transportation (DOT) approved helmet at all times.

Additionally, riders must wear protective eyewear, such as goggles or a face shield, unless their motorcycle is equipped with a windscreen.

Lane Use and Passing Laws

New York law permits motorcycles to:

  • Use an entire lane like any other motor vehicle.
  • Ride two abreast in a single lane, meaning two motorcycles can ride side by side.

However, lane splitting, which is riding between lanes of stopped or moving traffic, is strictly illegal in New York. Violating this law can  result in fines and points on a rider’s license.

Passenger and Equipment Regulations

  • A motorcycle must be equipped with a designated passenger seat and footrests if carrying a passenger.
  • Passengers must be at least five years old.
  • The motorcycle must have operational brakes, turn signals, mirrors, a working headlight, and a horn.

New York also mandates that motorcycles have daytime running headlights for increased visibility.

Motorcycle Insurance Requirements

All motorcycles must carry minimum liability insurance in New York:

  • $25,000 per person for bodily injury
  • $50,000 per accident for bodily injury
  • $10,000 for property damage

Failure to maintain insurance can result in registration suspension and fines.
